Coaching Agreement and Release

This page holds the documents you accept when you join a coaching group: the Coaching Agreement, the Assumption of Risk and Release of Liability, the health screening, and the optional Media and Testimonial Release. Please read them in full before you accept. If anything is unclear, ask us first: healthhishtadlus@gmail.com.

Coaching Agreement

1. Parties and acceptance

This Coaching Agreement (the "Agreement") is between Health Hishtadlus Inc. ("we," "us," "our") and you, the person joining a coaching group ("you"). You accept it during coaching onboarding, and it takes effect when you do.

2. What is included

  • A place in a coaching group led by our founder, in which you are paired with one other participant (your partner is another participant, not the coach).
  • A weekly video call shared by you, your partner and the coach.
  • The method: two 10-minute bodyweight sessions at home each week.
  • The group nutrition track: food allowances set by the coach, eating-day plans you build and repeat, and a daily log.
  • The tracker, free for the length of your group. It does not bill you automatically when the group ends.
  • The outcome guarantee described in section 6.

3. Length of the group

The length of your group (the "Program Period") is fixed and told to you in writing before the group starts. We will never shorten it once it has begun. We may extend it, which can only give you more time, never less.

4. Price and payment

The price, the payment method and any installment schedule are agreed with you in writing before you enroll. Coaching is paid off-site by that agreed method; no payment for coaching is taken on the Site. If you agreed to pay in installments, the remaining installments stay due if you withdraw after the group has started, unless the medical pause in section 7 applies.

5. Cancellation and refunds

  • Before the start. If you cancel before the group start date, we refund everything you have paid, in full.
  • If we cancel or postpone. If we cancel the group, or move its start date and you do not want the new date, we refund everything you have paid, in full.
  • If your doctor says no. If you answered yes on the health screening and your doctor advises you not to take part, tell us before you begin training and we refund everything you have paid, in full.
  • After the start. Once the group has started, coaching fees are non-refundable. The outcome guarantee is your remedy from that point.
  • If we remove you. If we remove you from the group for any reason other than your breach of this Agreement or the Terms & Conditions, we refund the unused portion of what you paid, in proportion to the part of the Program Period that remains.

6. The outcome guarantee

The outcome guarantee in Section 6 of our Terms & Conditions (summarized on our Guarantee page) is part of this Agreement. In short: coaching is one program, so you qualify by doing both halves of the work, training at least twice a week and eating on plan at least six days a week (logged in the tracker), each in at least five-sixths of the weeks of the Program Period. If you do, and either result that applies to you (stronger; and lighter, if your BMI was 25 or more at the start, which you reach by ending at least 3% lighter or by ending with a BMI under 25) is not reached when it is judged at the end of the Program Period, you get a free seat in the next available group. The Terms set out the full rules and govern the guarantee.

7. Medical pause

If a doctor advises you to stop or pause training during the group, tell us and send us a doctor's note. You may then transfer, at no charge, to a later group, and your guarantee is measured in that group instead of this one. Never train through pain, or against medical advice, to protect the guarantee.

8. Your partner and confidentiality

  • Your partner sees your first name and whether you trained this week, and hears what you share on the joint weekly call. Your partner does not see your weight, your BMI, your eating log or your repetition counts.
  • You agree to keep what you learn about your partner, on calls or otherwise through the group, confidential, and not to share it with anyone outside the group.
  • The coach's notes about you are private to the coach and are never shown to your partner.

9. Calls

Calls are not recorded unless everyone on the call agrees first.

10. Not medical care

The coach is a personal trainer, not a doctor, dietitian or other licensed health professional. Coaching is not medical care. Nutrition guidance in the group is general and non-medical, and it is never the diagnosis or treatment of any condition. Keep your own doctor informed, and where their advice differs from ours, follow theirs. Our Health & Medical Disclaimer applies in full.

11. Conduct

You agree to treat your partner, the coach and the group with respect; to keep other participants' information confidential; and not to share paid program materials outside the group. Harassment, abusive conduct, or disclosing another participant's information is a breach of this Agreement.

12. Removal

We may remove you from the group if you breach this Agreement or the Terms & Conditions, and no refund is due in that case. If we remove you for any other reason, you receive the pro-rata refund in section 5.

13. Other documents

Our Terms & Conditions, Privacy Policy and Health & Medical Disclaimer also apply to coaching. If any of them conflicts with this Agreement on a coaching matter, this Agreement governs.

14. Changes

If we change this Agreement, the new version applies to groups that start after the change, and we will ask you to accept it again before you join another group. The version you accepted governs the group you are in.

15. Governing law

This Agreement is governed by the laws of the Commonwealth of Massachusetts, United States, without regard to its conflict of law provisions, and disputes are resolved as set out in the Terms & Conditions.

Assumption of Risk and Release of Liability

PLEASE READ CAREFULLY. THIS IS A RELEASE OF LIABILITY. BY ACCEPTING IT YOU GIVE UP CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE FOR ORDINARY NEGLIGENCE.

In this Release, "I" and "me" mean you, the participant.

1. The risks

Exercise carries real risks, including muscle strains, joint injuries, falls, cardiovascular events such as a heart attack, and, rarely, death. These risks exist at every fitness level and even with careful instruction. Changing what you eat also carries risks: it can affect your blood sugar and the way some medications work (for example, medication for diabetes or blood pressure).

2. My health and my safety

I confirm that:

  • I answered the health screening truthfully and completely.
  • If I answered yes to any screening question, I was advised to talk to my doctor before starting, and I take part on my own responsibility. If I reported chest pain, fainting or losing consciousness, or a doctor's instruction to exercise only under supervision, I will not train until I have sent my doctor's OK to healthhishtadlus@gmail.com.
  • I will tell the coach if my health changes during the group.
  • I will stop at once, and seek medical care, if I feel pain, chest discomfort, dizziness, faintness, or shortness of breath beyond normal effort.
  • I am responsible for a safe place to train: a clear floor, stable surfaces and equipment, and suitable clothing and footwear.

3. Assumption of risk

I take part voluntarily. I understand the risks described above, and I knowingly and voluntarily assume all of them, both known and unknown.

4. Release

To the fullest extent permitted by law, I release, waive and discharge Health Hishtadlus Inc. and its owners, officers, employees, trainers and contractors (the "Released Parties") from any and all claims, demands and liability for injury, illness, death, or loss of or damage to property, arising out of or related to my participation in coaching, including claims caused by the ordinary negligence of any Released Party.

This Release does not apply to gross negligence, recklessness or intentional misconduct, or to any liability that the law does not allow to be released.

5. Covenant not to sue

I agree not to sue any Released Party on any claim released above.

6. Who this binds

To the extent the law allows, this Release binds me, my heirs, my estate, my personal representatives and my assigns.

7. Severability

If any part of this Release is held unenforceable, that part is enforced to the fullest extent the law allows, and the rest of this Release remains in full force.

8. Acknowledgement

I have read this Release. I understand it, I had the chance to ask questions before accepting it, and I accept it freely, knowing that I am giving up certain legal rights. I accept it by typing my full name, which has the same effect as my handwritten signature.

Health Screening

Before your first session you answer twelve yes-or-no questions. They are our own wording, modelled on standard pre-exercise screening, and they exist for one reason: so that anyone for whom exercise or a change of diet could carry a particular risk checks with their doctor first.

  1. Has a doctor ever said you have a heart condition or high blood pressure?
  2. Do you feel pain in your chest at rest, during daily activities, or when you are physically active?
  3. In the past 12 months, have you often felt dizzy or lost your balance because of dizziness?
  4. In the past 12 months, have you fainted or lost consciousness?
  5. Have you been diagnosed with any other chronic medical condition?
  6. Do you take prescribed medication for a chronic medical condition?
  7. Do you have (or have you had in the past 12 months) a bone, joint or muscle problem that more activity could make worse?
  8. Has a doctor ever said you should only do medically supervised physical activity?
  9. Are you pregnant, or have you given birth in the past 6 months?
  10. Have you ever been diagnosed with or treated for an eating disorder?
  11. Do you take medication for diabetes, including insulin?
  12. Do you know of any other reason you should not take part in physical activity or change the way you eat?

If you answer yes

You can still finish joining; a yes never shuts you out. What happens next depends on the question. Most yes answers (a heart condition or high blood pressure, dizziness, another chronic condition, prescribed medication, a bone, joint or muscle problem, pregnancy or a recent birth, an eating disorder, diabetes medication, any other reason): we recommend you talk to your doctor before you start and tell your coach so your training can be adjusted, you confirm that you take part on your own responsibility, and you start with everyone else. Three answers are different: chest pain, fainting or losing consciousness, and a doctor telling you to exercise only under supervision. These can signal a problem that exercise could make dangerous, so for them we need your doctor's OK before your first session. Email it to healthhishtadlus@gmail.com (a photo of a short note, or a forwarded message from your doctor, is enough). Until it arrives your workout tracking stays locked and we do not start training you; everything else on your account stays open. If the OK comes after your group has started, you can start late (the guarantee allows a few missed weeks, one-sixth of the Program Period, and a late start uses up part of that allowance) or move to the next group at no charge. If your doctor advises against taking part, you get a full refund (section 5). A yes does not mean you cannot train. It means the decision belongs to your doctor, not to us.

Who sees your answers

Only the coach sees your answers, and they are used only for your safety: to know when to ask for a doctor's OK and how to adjust your training. They are never shown to your partner, never used for marketing, and never sold. See our Privacy Policy.

If something changes

If an answer changes during the group (a new diagnosis, a new medication, a pregnancy, an injury), tell the coach before your next session.

Media and Testimonial Release (optional)

This release is optional. You never have to accept it to join a group, and saying no changes nothing about your coaching.

If you choose to accept it, you give Health Hishtadlus Inc. permission to use, in its marketing (on the Site, on social media, in messages and in print):

  • your first name;
  • quotes of what you say or write to us about your experience;
  • your progress numbers (for example, the percentage of weight you lost or the levels you reached);
  • photos, only if you send them to us for this purpose.

We never use your last name or your health screening answers under this release. Any result we show will be labelled as an individual result, not a typical one or a promise. No payment is owed for this permission.

You can withdraw this permission at any time by emailing healthhishtadlus@gmail.com. From then on we will not use your name, words, numbers or photos in anything new, and we will take them down from the Site and our own social accounts where we reasonably can. Material already printed or shared before we received your email may remain in circulation.
